HTEAO WEBSITE TERMS OF USE

These Terms of Use (“Terms”) govern your access and use of our website (“Site”) and the services available via that Site (collectively, the “Services”) provided by HTeaO FC, LLC or its affiliates (“HTeaO”, “we”, “our” or “us”) or on behalf of HTeaO by one of our third party service providers. Use of the Site and any Services via the Site is subject to these Terms. If you do not agree to these Terms, do not access the Site or any Services.

THESE TERMS CONTAIN AN AGREEMENT BY YOU TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS. PLEASE REVIEW THE ARBITRATION SECTION BELOW SINCE YOU ARE GIVING UP CERTAIN RIGHTS, SUCH AS THE RIGHT TO A JURY TRIAL AND THE RIGHT TO SUE HTEAO IN A CLASS ACTION LAWSUIT.

Modifications to these Terms
We may modify these Terms at any time. Material changes will be conspicuously posted on the Site or otherwise communicated to you. All changes will be effective upon posting to the Site. By accessing or using the Site after changes are posted, you agree to those changes. However, if HTeaO modifies the arbitration provision below, you may reject that change by sending HTeaO written notice within thirty (30) days of our posting of the change, in which case you must immediately stop using the Site.

Privacy Policy
We collect certain information about you when you access and use our Site. Our collection and use of information about you is described in our Privacy Policy. By using our Site, you acknowledge receipt of our Privacy Policy.

Mobile Terms of Service

The HTeaO mobile message service (the "Service") is operated by HTeaO (“HTeaO”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes constitutes your acceptance of such changes.

By consenting to HTeaO’s SMS or text messaging service, you agree to receive recurring SMS or text messages from and on behalf of HTeaO through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

Service related messages may include updates, alerts, and information such as order updates or account alerts. Promotional messages may include promotions, specials, cart reminders, and other marketing offers.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with HTeaO. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS or text messages.

You may opt out of the Service at any time. Text STOP to +18664039282 or click the unsubscribe link, where available, in any text message to cancel. You will receive a one time opt out confirmation message and no further messages will be sent unless initiated by you. If you have subscribed to other HTeaO mobile message programs, you may need to opt out separately from those programs.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. Messages sent to outdated numbers may not be received and we are not responsible for such messages.

Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and if you change numbers you must re subscribe.

To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery of any information sent through the Service or for any actions taken in reliance on the Service.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect and use your information.

The Site, including any text, audio, video, graphics, interfaces, icons, software, code, data, documentation, other components and content, and the design, selection, and arrangement of content, and all intellectual property rights in the foregoing (collectively, “Content”) are exclusively the property of HTeaO or its licensors. HTeaO owns certain trademarks, names, logos, insignia, or service marks (“Marks”), which may appear in the Content. You do not have the right to use any Marks except as expressly agreed to in writing by us. The Site may also contain third party Marks and third party copyrighted materials, which are the property of their respective owners.

Intellectual Property Rights
The Site and its Content, including the Marks, are protected by copyright, trademark, and other intellectual property laws. Any unauthorized use is strictly prohibited.

License to use the Site
Subject to your compliance with these Terms, HTeaO grants you a limited, non exclusive, non transferable license to access and use the Site solely for personal use.

Modifications to the Site
HTEAO MAY MODIFY THE SITE OR SERVICES AT ANY TIME WITH OR WITHOUT NOTICE.

Information provided is for general informational purposes only and is not guaranteed to be accurate or up to date.

Orders and Online Shop
Orders may be placed online and require payment at the time of purchase. Purchases are subject to our Return Policy.

Compliance with Laws
You are responsible for complying with all applicable laws.

Indemnification
You agree to indemnify and hold HTeaO harmless for claims arising from your use of the Site or violation of these Terms.

We are not responsible for third party websites linked from the Site.

The Site is intended for use in the United States only.

Term and Termination
We may restrict or terminate your access at any time.

Cooperation with Law Enforcement
We may cooperate with law enforcement requests.

Assignment

Waiver
Any waiver must be in writing.

DISPUTE RESOLUTION AND ARBITRATION
Disputes must be resolved through binding arbitration on an individual basis in Tarrant County, Texas.

Governing Law
These Terms are governed by the laws of Texas.

Entire Agreement
These Terms together with the Privacy Policy constitute the entire agreement.

Severability
If any provision is invalid, the remaining provisions remain in effect.
